Terms & Conditions


Definitions:

1.1 'Buyer' means the person that is named on the invoice.
1.2 'You' means the buyer.
1.3 'We', 'our', 'us' means: Pure Energy Multimedia Ltd (abbreviated as ‘Pure Energy’).
1.4 'Invoice'- this is the document titled 'invoice' received on completion of the 'contract'.
1.5 This is the legally binding agreement between the buyer and Pure Energy Multimedia Ltd.
1.6 'Contract' this term refers to any legally binding agreement between Pure Energy Multimedia Ltd and the buyer.
1.7 'Goods' and 'Products' are the physical items detailed on the invoice.
1.8 'End User' this is the person who will use the goods-not necessarily the buyer.

Terms and Conditions of Sale:

2.1 The buyer agrees to pay Pure Energy Multimedia Ltd for the goods supplied.
2.2 Goods can be paid by Credit or Debit Card, by PayPal or by cheque.
2.3 The Goods ordered by the buyer will be dispatched upon the receipt of payment from the buyer, to the address specified on the order.
2.4 Whilst all care is taken by Pure Energy Multimedia Ltd to describe all products as accurately as possible there may be slight variations between the products shown on the website www.pureenergymultimedia.com and the products received.
2.5 Pure Energy Multimedia Ltd reserves the right to change or modify any of their products without prior notice.
2.6 If the buyer has not received the goods in accordance with the invoice then it is the responsibility of the buyer to inform Pure Energy Multimedia Ltd of any suspected discrepancy.
2.7 Postage & Packing prices are for UK Mainland orders only. If you would like to place an order from outside the United Kingdom please contact our sales department at: sales@pureenergymultimedia.com and we will send you a Request for Payment for the products you require as well as the Shipping costs to your destination.

Receipt of Products:

3.1 Once the goods have been received by the buyer, all responsibility for their use is with the buyer themselves.
3.2 If the buyer is not the end user then it is the buyer's responsibility to ensure the end user is aware of all terms of this contract - in particular the conditions as to the use of the product.
3.3 Pure Energy Multimedia Ltd accepts no responsibility for any loss arising out of negligent use of the products by the end user or by any third party.
3.4 The instructions as to the use of the goods must be read and understood in its entirety prior to use of any Pure Energy product.
3.5 If there are no instructions accompanying the goods then please contact our sales department at: sales@pureenergymultimedia.com that will provide the buyer with a copy of the relevant information.
3.6 In the event that any instruction is not understood or if there are any queries as to the use of the products then the products must not be used until such time as the buyer is satisfied as to the correct use of the products.
3.7 Pure Energy Multimedia Ltd will try within all reasonable limits to ensure any queries relating to its products or goods are answered to the buyer's satisfaction.

Limitations:

4.1 In any event, Pure Energy Multimedia Ltd shall not be liable under, or in connection with these terms and conditions in contract, tort, negligence, pre-contract or other representations or otherwise for any damages or consequential loss whatsoever.
4.2 The provision of this clause (Clause 4 and its sub-sections) shall be construed separately, applying and surviving even if for any reason one or all of the other clauses are deemed inapplicable or unenforceable in any circumstances and shall remain in force not withstanding the expiry or termination of our agreement.

Use of Products:

5.1 All Pure Energy products, unless otherwise stated, are for the intended use only. They must not be tampered with or changed in any way - any changes or alterations made to Pure Energy products will immediately invalidate the warranty.
5.2 It is the buyer's responsibility to ensure that the products are used in full accordance with the instructions.
5.3 Pure Energy Multimedia Ltd cannot accept any responsibility whatsoever for any loss or injury resulting from the proper or improper use of their products.
5.4 Pure Energy Multimedia Ltd will not accept liability for use of any of its products that is not in accordance with the instructions enclosed with each purchase.

Faulty or Damaged Goods & Shortages

6.1 In the event of any Pure Energy product arriving damaged or if on inspection the goods are faulty, please repackage the goods and notify us immediately by calling our Customer Services department on: +44 (0)1440 709794 or by email at: info@pureenergymultimedia.com.
6.2 Pure Energy Multimedia Ltd will either arrange collection of the faulty or damaged items or will instruct the buyer on how to return the goods.
6.3 Items found not to be damaged or faulty will be treated as per condition 7.2
6.4 Any claims for Faulty/Damaged Goods or Shortages must be made within 7 days of receipt.
6.5 Where possible we will arrange for any shortages to be delivered to you. In the event of us being unable to do this we will exchange your product with another one.
6.6 Your Statutory Consumer Rights are Unaffected.

Cancellations, Refunds & Exchanges:

7.1 If you are not entirely satisfied with your goods you have the right to cancel your order. To do this, please contact us. You do not have to give us a reason for cancellation; however, a brief explanation will help us to improve the service we offer to customers in the future
7.2 If you cancel an order and require an exchange or refund you must return the goods to us at your own expense within 14 days of placing your order.
7.3 You must ensure that the goods are packaged adequately to protect against damage. We highly recommend that you obtain proof of posting or use a recorded/insured service for returning any items as we regret we cannot be held responsible for goods lost or damaged in transit.
7.4 We will refund the total value of the goods (less delivery charge) on satisfactory receipt of them, which must be received in good condition, and refund you using the payment method you used at the time of purchase, within 30 days of receiving your notice to cancel.
7.5 Goods must be returned in a re-saleable condition including all packaging and associated material like instructions etc.
7.6 Damaged goods not meeting clause 7.5 may be subject to a minimum surcharge of 20%. Items that are deemed un-saleable will be charged for in full.
7.7 The decision of Pure Energy Multimedia Ltd is final.
7.8 Your Statutory Consumer Rights are Unaffected.

Exclusions:

8.1 Whilst Pure Energy Multimedia Ltd tries to ensure that all of our products meet the high standards expected by our customers there may be certain times when we may be unable to meet them, these are but not necessarily limited to force majeure where there are circumstances beyond our control e.g. acts of God, strikes, lock outs, accidents, war and acts of terrorism. This list does not exclude other such events beyond our reasonable control.
8.2 In any such event as detailed in 8.1 Pure Energy Multimedia Ltd shall try to resolve any such problem insofar as it is practicably possible.

Applicable Law:

9.1 We reserve the right to change our terms and conditions without prior notice in accordance with the relevant or applicable law.
9.2 If you have any queries regarding these terms then please contact Pure Energy Multimedia Ltd at: sales@pureenergymultimedia.com We will try to resolve any queries as soon as possible.
9.3 Each of the Clauses of these Terms and Conditions shall be construed separately (unless otherwise stated) and independently of each other. Invalidity of any one part shall not affect the validity of any other part.
9.4 This agreement shall be governed by the laws of England and you agree to submit to the exclusive jurisdiction of the English courts.
9.5 Your statutory consumer rights are unaffected by these terms and conditions.
